Derrick Rose’s summary judgment filed in federal court to have the civil sexual assault case against him dismissed was denied on Wednesday in California. This means a civil trial against Rose is set to begin October 4 in Los Angeles. This likely coincides with the New York Knicks’ training camp.
Judge Michael W. Fitzgerald of the United States District Court in the Central District of California stated the motion was denied due to “genuine dispute of the material fact” that there was consensual sex between the two parties back in August of 2013. Therefore the jury and not the court needed to resolve that dispute of the fact and the summary judgment to have it dismissed was deemed “improper.”
The Motion is DENIED. The record presents a genuine dispute of material fact as to the central issue in this action: whether Plaintiff consented to sexual intercourse with Defendants in early morning of August 27, 2013. Because the jury and not the Court must resolve this central issue, summary judgment is improper.
Depending on the length of the trial and the timing of it, there is the possibility that Rose could miss games for the Knicks during the preseason and possibly into the regular season as well. Rose was traded from the Chicago Bulls to the Knicks earlier in the summer. This will be his first season on a team other than the Bulls and he will be a free agent in the summer of 2017.
